EU laws retained in no-deal Brexit scenario

A Department of Health & Social Care (DHSC) bulletin – ‘The Nutrition (Amendment etc.) (EU Exit) Regulations 2019: Practical Changes for Industry’ – detailed changes to domestic and EU nutrition legislation that will be made by the EU (Withdrawal) Act 2018 and existing nutrition regulations in the event that the UK leaves the EU without a deal.
The most notable change would be the transferral of responsibilities from EU organisations involved in risk assessment and management processes for nutrition legislation to UK bodies.
Transferring powers
Functions and powers currently carried out by the EC, such as deciding whether to authorise applications for new health claims, will be transferred to appropriate authorities – the secretary of state in England, ministers in Scotland and Wales and the Department of Health in Northern Ireland.
Where legislation amended by the Nutrition (Amendment etc.) (EU Exit) Regulations 2019 requires a list or register to be established, each appropriate authority must produce and maintain a list or register.
